Ph.D. Program

The ph.d. in law degree.

The Ph.D. in Law degree program is designed to prepare J.D. graduates for careers as legal scholars and teachers through a doctoral program aimed at the production of a substantial body of academic research and writing under the close supervision of a three-member faculty dissertation committee. Unlike programs designed for students who wish to learn about law from the disciplinary perspectives of the social sciences or the humanities, the Ph.D. in Law is directed at students who wish to pursue advanced studies in law from the perspective of the law. This program offers emerging scholars an opportunity to contribute to the development of law as an academic field, and it provides an alternate pathway into law teaching alongside existing routes such as fellowships, advanced degrees in cognate fields, legal practice, and clerkships.

Because our entering Ph.D. students will have already completed their J.D. degrees, the anticipated course of study toward the Ph.D. in Law degree is three academic years and two summers in residence. In their first two semesters, Ph.D. students will enroll in courses designed to help them acquire the background and research skills needed to complete a dissertation in their field of interest and to prepare them for qualifying examinations that test the depth and breadth of the literacies and skills they have acquired. During their second year, students will prepare a dissertation prospectus and begin work on a dissertation. The dissertation may take the form of either three law review articles or a book-length manuscript and will make up a portfolio of writing that will be essential for success in the job market. Ph.D. students will also gain experience in the classroom, and receive the full support of Yale Law School’s Law Teaching Program , which has had remarkable success in placing graduates in tenure-track positions at leading law schools.

Ph.D. students receive a full-tuition waiver, a health award for health insurance coverage, and a stipend to cover their year-round living expenses, as well as support for participation in national and international conferences.

Applications for admission to the Ph.D. in Law program are available starting on August 15. The deadline for submission of all materials is December 15. Applicants to the Ph.D. in Law program must complete a J.D. degree at a U.S. law school before they matriculate and begin the Ph.D. program. What is a degree emphasis? Is it the same as a concentration?

  • A concentration is a formalized selection of courses within a major. A concentration requires a minimum of 15 credit hours of which at least nine credit hours must be upper division. Your concentration appears on both your ASU diploma and your transcripts.
  • An emphasis is a selected topic area defined within the major. It’s typically 9–12 credit hours and doesn’t need to be officially declared. The emphasis will not appear on your diploma or transcripts.

Will my legal studies degree say 'online'?

No, Arizona State University’s diplomas don’t specify whether you earn your degree online or in person. All diplomas and transcripts simply say “Arizona State University.” That’s because ASU Online students learn from the same faculty and receive the same course content as in-person students receive.

Please note your diploma will state the degree you earn: Master of Legal Studies. Your emphasis in contract management will not appear on your diploma or transcripts.

U.S.-educated applicants can apply through our FastApp process, which streamlines the application process and may allow for an offer of conditional admission to the MLS program while the applicant continues to submit any additional requested documentation. Possible outcomes from FastApp submission may include:

  • Conditional admission.
  • A request for supplementary documents.
  • A request to complete the full MLS application with accompanying documents.

  For the FastApp application to be considered complete, it must include:

  • An unofficial transcript from all undergraduate and graduate institutions attended.
  • Resume that does not exceed three typed pages.

If a decision cannot be made from a FastApp, our admissions team may request additional information from an applicant, including any or all of the following:

  • Writing sample.
  • Explanations to affirmative answers to any conduct questions.
  • Two letters of recommendation.
  • Transcripts from all institutions attended, including the transcript showing a bachelor's degree was conferred.

Application requirements

A minimum of a 3.00 cumulative GPA in the last 60 hours of an applicant’s bachelor's program is preferred. Prospective students may earn admission with a cumulative GPA below 3.00 if the other assets included in the application package are strong, such as but not limited to:

  • A personal statement that addresses a low GPA or inconsistent academic performance.
  • Improved academic performance in subsequent degrees.
  • Significant work history since completing a bachelor’s degree.

All applicants must submit:

  • Graduate admission application.
  • Official* transcripts.
  • CV or resume.

*Transcripts can be unofficial through the FastApp process. Official transcripts reflecting degree conferral(s) will be required if an applicant is admitted.

If English isn’t your native language and you haven’t completed a bachelor’s degree or higher at a regionally accredited institution in the U.S., you must provide evidence of English proficiency .

Description.

Understand the legal issues related to government contracts, the rules that apply and how the facts determine the outcome of the case. Read and discuss actual cases that illustrate the contract issues covered.

Consider the legal issues related to appropriations, authority, the Christian Doctrine, intellectual property, sealed bidding, simplified acquisitions, competitive negotiation, late bids or proposals, responsibility, unfair competitive advantage, conflicts of interest, the set aside Rule of Two, the Severin Doctrine, constructive changes, terminations, suspensions of work, differing site conditions, contract fraud, ethical considerations and unfair competitive advantage.

All acquisition professionals including Contracting Officers, Project/Program Managers, and CORs, and other administrative and legal personnel involved with government contracts.

At what point is an offer official?

Every research job/position I've ever had, I have had some sort of "informal" (verbal, via email) offer, followed by me showing up the first day of work to sign the contract and start. This is in Europe, where salaries for such positions are regulated and public knowledge so there was nothing to negotiate.

However, in conversations with people outside of academia, they view this as highly irregular. So I was wondering at what point an offer becomes "official"? At what point would you start thanking your references, rejecting other offers, looking for a new apartment, ..? When you get the "informal" offer, when you get a "formal" offer letter, when you sign the contract?

For me, the moment there's an offer ("we would like to offer you the position") and an acceptance (regardless of the form), it's "official" and I will start the process of notifying everyone and making arrangements if a move is necessary. Is this naive?

PS: I'm posting here rather than over at the Workplace StackExchange because I think this is an area where academia might differ from other jobs. If working in industry, I would never consider anything official until a contract has been signed.

  • 3 To me, this seems very irregular in the academic setting, too. Nodody that I know would reject other offers before an official and legally binding contract is signed. The same is true vice versa - no academic institute would settle the candidate search before a contract has been signed. I am writing this from a central Europe perspective (Germany, Netherlands, Austria) - apparently there are differences across regions and maybe even disciplines. –  LuckyPal Commented Jan 10, 2022 at 8:20
  • @LuckyPal I had a German university already listing what courses I'd be teaching on their website at a moment where I hadn't signed anything yet. As a postdoc in the UK, I didn't sign anything that really looked like an employment contract to me during my 4 year position. –  Arno Commented Jan 10, 2022 at 14:49
  • @Arno interesting. This confirms that there are large differences. My experience is mainly with medical universities. At my current institution it is not possible to start working within ~4 weeks after signing the initial contract, as you need a medical examination and a confirmation from the staff council (which you are only eligible for with a signed contract :) ) before you receive an email account, network access, etc. Of course, informally, people may already start writing grants, preparing teaching material, etc. but in now way does this guarantee that they will actually get the job. –  LuckyPal Commented Jan 10, 2022 at 16:23
  • @Arno anecdotally, I was also listed at a institution's website as their statistician before the contract was signed. Then, the start of the position got actually delayed by 6 months due to some adminstrative issues. If I would have trusted the oral agreement, I would have been screwed! Probably, the listing on their website is kind of a legally binding job offer, but I highly doubt it is fun to sue an academic institute for the equivalent of a few months salary. –  LuckyPal Commented Jan 10, 2022 at 16:34

This is essentially a legal question, relating to when binding legal relations exist between an employer and a prospective employee. If you would like to understand this well, you should have a look into the basics of contract law, particularly in the context of workplace law. Contract law generally recognises a legally-binding contract to exist once there has been an offer and acceptance , even if this has not yet been formalised in a written "contract". So as a general rule, if they have verbally offered you a position and you have said yes, that is a legally binding contract.** Often the communication of an offer/acceptance is done by email, in which case there is also documented evidence of offer/acceptance. The purpose of a formal document is to set out the relevant terms of employment, and to act as evidence of the agreement and its terms.

So, your general position that it is "official" once there is an offer and acceptance is correct. The only potentially naive part about this is to consider whether you have evidence of the offer/agreement, whether the other party will be honest about this in the event of a dispute, and whether the terms of the agreement are sufficiently specified to avoid too much wriggle-room on the other end. If there is a dispute over the agreement, and it was purely verbal, are they going to admit that an offer was made? Will they characterise it accurately? Will they assert that it was conditional on anything? Can you prove your asserted position? For that reason, when I am dealing with these things, I will generally ask them to send me an email with their offer and I will email back with acceptance; that is enough to ensure that there is a binding agreement that I can prove .

You should also bear in mind that some offer of employment come subject to various conditions (e.g., background checks, probationary period, etc.) and their verbal/email offer might refer generally to conditions that are not yet fully specified until you see the formal "contract". For this reason, it is generally a good idea to wait until you see this formal document, to ensure that you are in agreement with them about any required conditions, etc., for your employment. If you are unsure of the legal status of your agreement, contact an employment lawyer and they can assist you.

** Even before this, if the employer has led you to believe you have a position with them, and then you don't get it, they can sometimes be liable for misleading or deceptive conduct.

In universities, if you do not have a contract signed by yourself and the appropriate university official, you do not have a job.

This is more consistent in academia than it is in "industry" because "industry" includes the informal economy where contracts are not written.

  • 4 Oddly enough, my experience is the exact opposite. I suspect that your answer is not widely applicable and would benefit from more context: Legally, a written, signed and countersigned contract is ironclad. In Europe, a verbal contract (or acceptance of an email offer) is as binding, even if the employer's representative can't extend the offer (but the candidate may reasonably assume they can). Verbal is harder to prove, so whether the point is worth litigating is another topic entirely. This is likely to depend on the local legal framework. Which will affect the incidence of withdrawn offers. –  MvZ Commented Jan 10, 2022 at 10:03

  • 1 In your answers, you sometimes make sweeping generalizations that may not apply to the complex variety of the academic world. For instance, for this one, I don't have a contract signed by myself, but this notwithstanding I have had a permanent position for 22 years now, receiving regular salary. How is this possible? Because I've been hired by a so called rectoral decree which does not require the signature of a contract. This has somehow the unpleasant consequence that when I have to hire an apartment, if I have to go abroad for long periods, I don't have anything to show that I have a job! –  Massimo Ortolano Commented Jan 10, 2022 at 16:11

  • 2 @MassimoOrtolano To some extent, this is also true as a civil servant in Germany (i.e. professors in most German states): As a civil servant, you get appointed, rather than signing a contract. 12 PhD Positions (fully funded) | Cologne Graduate School of Ageing Research

The Cologne Graduate School of Ageing Research (CGA) in Germany is a joint venture of the University of Cologne Excellence Cluster on Stress Responses in Aging-Associated Diseases (CECAD), the University Hospital Cologne, the Max Planck Institute for Biology of Ageing and the Max Planck Institute for Metabolism Research. Cologne has emerged as a leading global research cluster with a stellar constellation of institutes and scientists dedicated to ageing research in Life Sciences.

We offer up to 12 fully funded PhD positions to highly motivated and talented researchers. The structured PhD training programme within a cutting-edge research environment will start on an individual basis between July 1 and October 1, 2025. The initial contract is limited to three years. Payment is based on the German TV-L E13 scale, 65% if terms and conditions under collective bargaining law are fulfilled or on an equivalently remunerated PhD support contract of the Max Planck Society.

Government Procurement Courses and Degree Offerings

Our experiential, practice-based curriculum prepares students for the demands of a complex procurement law practice. We offer an unmatched variety of degrees for government procurement attorneys and acquisition professionals. The courses in this practice area explore the laws governing government procurement regimes and processes.  Government Contracts Overview  is a one-semester survey course for students seeking a general overview of the law in this area; those preferring a more in-depth course of study may choose instead the Formation of Government Contracts and Performance of Government Contracts sequence. Advanced courses in this area include a series of seminars and courses designed to provide students with a richer understanding of how procurement systems operate, both in the U.S. and abroad, and selected topics courses designed to provide students with varying per­spectives on emerging issues in the law.

JD Concentration in Government Procurement

JD candidates may earn a JD Concentration in Government Procurement Law by completing at least 12 credits of Government Procurement Law courses, including Formation of Government Contracts (6502), Performance of Government Contracts (6503), two credits of an experiential learning government procurement course (or government procurement Field Placement), and a paper on a topic related to government procurement law that meets the standards for the law school’s legal writing requirement. LLM and MSL Specialization in Government Procurement Law

The GW Law Government Procurement Law Program offers four separate 24-credit degree programs, the Master of Laws (LLM) in Government Procurement and Government Procurement & Environmental Law, and the Master of Studies in Law (MSL) in Government Procurement and Government Procurement & Cybersecurity Law. The programs require students to examine government procurement laws, regulations, and procedures, and develop communication, writing, and critical-thinking skills. The LLM and MSL in Government Procurement Law degrees are flexible, providing students with  the opportunity to take courses online, on-campus, or a mixture of the two formats.

As the only program of its kind in the United States the GW Law Government Procurement Law LLM Degree continues to set the standard for excellence in the field. Many graduates of the Government Procurement Law LLM Program hold prominent positions in government agencies, the Judge Advocate General’s Corps, law firms, and corporations. Our LLM program offers unparalleled opportunities to learn, conduct research and publish, broaden your professional network, and engage with practitioners, adjudicators, and policy-makers.

Students must enroll in the following required government procurement classes: Government Contracts Overview (6518) (to be taken in the first semester), Formation of Government Contracts (6502), Performance of Government Contracts (6503), and Government Contracts Cost and Pricing (6506). Students must also complete a 4-credit written work requirement, which entails the completion of a thesis or two research papers written in connection with two separate 2-credit courses. For students who choose to write a thesis, Thesis I (6690), Thesis II (6691), and a minimum of 10 credits from the list of advanced or “elective” government procurement law courses. For students who choose to complete two research papers, a minimum of 14 credits, including the two separate 2-credit courses, from the list of "advanced" procurement courses are required. No more than 10 credits may be taken from the non-exhaustive list of “Courses Related to Government Procurement Law” found in the GW Law Bulletin. Sustainable or “Green” Procurement is a procurement process where governments use their purchasing power to buy goods and services with a reduced environmental impact. As governments increasingly integrate sustainability goals into procurement policies, there is a growing demand for knowledgeable attorneys who can navigate this emerging area of the law. Our LLM in Government Procurement & Environmental Law provides our students with the competitive advantage they need to excel in this critical area of the law.

A minimum of 16 credit hours from the following courses is required. For U.S. law school graduates, this requirement must include 4 credits graded on the basis of a research paper or research papers. This typically entails completion of Thesis (6690-91) or two research papers, each of which is written in connection with a separate 2-credit course. For non-U.S. law school graduates, completion of 2 credits graded on the basis of a single research paper or Thesis (6690-91) is required. Any research paper must be at least 8,000 words in length. U.S. law school graduates must achieve a minimum grade of B+ and graduates from non-U.S. law schools must achieve a passing grade for their research paper. For students who choose to write a thesis, Thesis (6690-91), and a minimum of 12 credits in the field of study are required. Students are encouraged to write a thesis. Programs leading to the degree of Doctor of Juridical Science offer a very small number of unusually talented students, who have already earned the Master of Laws degree, the opportunity to concentrate on research and writing in a specific area of interest.

For SJD applicants who earned their first law degree from a U.S. law school, the following requirements pertain. Applicants must hold a BA or equivalent degree from a regionally accredited college or university and a JD and an LLM or equivalent degrees, both earned with excellent records, from law schools that are members of the Association of American Law Schools (AALS) or approved by the ABA.

For SJD applicants who earned their first law degree at a non-U.S. law school, the following entrance requirements pertain. Applicants must have graduated with an excellent academic record from a non-U.S. law school known for high academic standards; such a determination will be made by the Graduate and International Programs Office or by a qualified faculty member. As outlined above for U.S. law school graduates, additional requirements include an LLM.

Candidates for the SJD degree must complete the following requirements to be awarded the degree: an enrollment period of not less than one academic year; a course of study and research, designated by the dissertation committee, of no less than 8 credit hours; and completion and acceptance of a dissertation (see below). The course work for the SJD degree will normally be completed during the first two years of study.

The Dissertation

The dissertation must be submitted no later than three years from the date of admission to candidacy for the SJD degree. The applicant who proposes to write on a comparative law topic must have a reading knowledge of the language in which the relevant materials are to be found. When the dissertation is submitted, the consultative committee will set the date for oral examination. This examination is conducted by the consultative committee and such other members of the faculty and qualified experts as are selected by the appropriate program director in consultation with the dean.

GW Law’s MSL helps meet the growing demand for non-lawyers to be familiar with the many ways that law influences industry. The MSL program is intended for professionals who are not interested in earning a law degree or practicing law but work in jobs where knowledge of the law is important. The knowledge gained can augment career preparation or professional advancement.

MSL candidates must complete 24 credits in order to graduate. Students must enroll in the following required government procurement classes: Government Contracts Overview (6518) (to be taken in the first semester), Formation of Government Contracts (6502), Performance of Government Contracts (6503), Government Contracts Cost and Pricing (6506), Analytical Writing (6519), and Anti-Corruption & Compliance (6511). Students must also write a research paper completed in a government procurement seminar course or in the graduate independent legal writing course (6696). There is increasing demand for cybersecurity legal expertise among government procurement practitioners. The successful implementation of these requirements will depend heavily on skilled legal reasoning and policy interpretation by acquisition professionals in federal agencies, private firms, and industry. The Master of Studies in Law (MSL) in Government Procurement and Cybersecurity Law Program is intended for professionals who are not interested in earning a law degree or practicing law, but who work in jobs where knowledge of this critical area of law is important.

M.S.L. candidates must complete 24 credits in order to graduate. University Statements

Update on cornell-uaw negotiations.

Dear Ithaca campus community,

As you may know, the university and the United Automobile Workers (UAW) have been working on a new collective bargaining agreement since April 2024. The UAW represents about 1,300 of our employees across campus, including in Dining, Building Care, Facilities, CALS, CVM and the Statler Hotel. The university and the UAW have had a productive labor-management relationship for more than 40 years, and we are committed to the continued success of this relationship and to reaching our next agreement.

Despite the best efforts of the university, the parties have not yet reached a new agreement. The parties have been successful on a number of key issues concerning the bargaining unit, such as health and personal leave (“HAP”), vacation consistent with university policy, and health and safety. We have proposed to the UAW that we use the federal mediator assigned to the negotiations or a mediator of the UAW’s choice to assist the parties in reaching a complete agreement. The UAW has rejected this suggestion.

The University’s latest offer to the UAW includes the following:

  • 6% wage increase in the first year, with additional increases in each of the additional proposed years.
  • Changes to wage rates based on years of service which, with the 6% increase, result in wage increases of at least 10% for more than half of the unit.
  • A reduction of the time for new employees to reach the job rate for their positions, from three years to one year.
  • An increased wage for our most senior employees, recognizing them at 10 years and 25 years of service.
  • Bonuses recognizing the longevity of employees at 5 and 15 years of service.
  • Increases to clothing and shoe allowances across the unit, including provision of these allowances to additional groups of employees.
  • Increased pay rates for employees providing peer-to-peer on the job training.
  • Increased eligibility for shift differential.
  • Support for tipped employees with retirement savings.

We are committed to continuing to bargain with the UAW to reach a new agreement.

The university is aware that the UAW has voted to authorize a strike and has scheduled a rally for today at Bailey Hall. If a strike is called, employees represented by the UAW may decide to join the strike or they may elect to report to work. We respect employees’ right to make this decision.

If the UAW calls a strike, the university has contingency plans in place to maintain essential services. Any shifts in operations, such as reduced dining hours or offerings, will be communicated on a rolling basis as these impacts may vary day to day. Employees with questions should consult with their supervisors for additional guidance on contingency plans.

The university continues to bargain in good faith. We remain hopeful we will find common ground on the remaining open issues and reach a tentative agreement acceptable to the employees represented by the UAW.
